Understanding the New IR35 Offset Facility

There’s a key update in the IR35 legislation that’s set to make things a bit easier for businesses working with contractors coming into effect soon! Starting from 6th April 2024, there’s an important change coming into play, known as the IR35 offset facility. This change is all about addressing a specific issue that has been a bit of a headache for many – double taxation.
What is IR35?
IR35 is a tax rule aimed at preventing tax avoidance. It’s focused on individuals who work through intermediaries, like Personal Service Companies (PSCs). Essentially, it ensures that the right amount of tax and National Insurance is paid, as if these individuals were directly employed.

Under the current rules, if a business (deemed as the employer) doesn’t comply with IR35, they end up paying PAYE tax and NIC. But often, the individual or their PSC might have already paid taxes on the same income. This results in the same income being taxed twice – which is not ideal!
